Carrying waste in the van has its own rules

In England, it is an offence to carry waste in the course of a business without being registered. There are exceptions.

A business that carries only waste it produced itself can register on the lower tier. Gov.uk says that is usually free, and it does not need renewing.

That tier leaves out construction and demolition waste. The regulations do not mention garden waste by name.

Read the rules, and the change already made

The Waste (England and Wales) Regulations 2011 say construction includes improvement, repair and alteration. Lower tier registration lasts indefinitely. Other carriers register for three years.

Gov.uk lists the current fees, and says you can get an unlimited fine if you do not register.

England is replacing this system. Regulations made on 22 July 2026 move carrying waste to an environmental permit or a registered exemption.

The main change starts at the end of the 12 months beginning with the day they were made. A business already on the lower tier then gets 12 more months to comply.

The new rules exempt carrying waste produced in your own business, subject to conditions. Wales keeps the current rules. In Scotland, the 1989 Act stopped applying from 1 November 2025.

What it does not do for a gardener

  • It does not repeat a weekly visit or send a monthly invoice by itself.
  • It does not register you as a waste carrier or keep waste records for you.
  • It needs a signal to work. There is no offline mode.

Frequently asked questions

Does CIS apply to garden work?

Not on a job for a householder, because a private householder is not a contractor under the scheme. HMRC's manual puts routine gardening outside it. Building walls, drives and patios is inside it.

Can I invoice a regular customer every month?

Yes, but not automatically. Each invoice comes from a job, so a regular visit is invoiced each time you do it.

Can a customer pay a deposit before I buy the slabs?

Yes, if you ask for one on the quote. They pay it by card on the link when they say yes. Card payments need your Stripe account connected.

What does the free tier include?

The free tier runs 3 quotes and 3 invoices a month, end to end: build the quote, send the PDF, let the customer approve it in the portal, and invoice it. The AI pricing and description tools, expense tracking, certificate filing and reports are Pro. The HMRC year-end tools are Pro + Tax. The cap is small on purpose. A free tier big enough to run a trade on has to be paid for by the traders who do pay, and they are one-person businesses on a flat £29 a month with no per-seat fee. What the free tier proves is the whole loop rather than the volume: build the quote, send it, let the customer approve it, invoice it.
